Ottawa police cruiser accident sends two Ottawa pedestrians to hospital with serious head injuries, neck injuries and back injuries.

Ottawa Injury Lawyers David Hollingsworth.

2 Ottawa pedestrians were seriously injured on Friday when an Ottawa police cruiser hit them just before noon. ?The Ottawa pedestrian accident occurred at the corner of? Elgin St. and Sparks St. One pedestrian was a woman in her 70s and the other injured pedestrian was a male in his 40s. ?When Ottawa paramedics arrived to the accident scene, both pedestrians were conscious and in stable condition but needed to be rushed to an Ottawa hospital for serious neck injuries, head injuries and back injuries. The cause of the accident is still unknown and when an accident involves a police cruiser, the ?Special Investigations Unit comes involved. They will collaborate with the Ottawa Police to determine the cause of the accident. ?My thoughts are with both accident victims at this time. I hope their injuries are not as serious as in the initial reports and that they are able to recover from this accident.

All pedestrians have rights to compensation whether or not they have their own insurance. Most pedestrian accidents ?result in serious long-term injuries or catastrophic injuries. ?Injured pedestrians?can claim ?compensation by filing an Ontario accident benefits claim as well as through a tort claim. A tort claim is a lawsuit ?filed against the person responsible for the accident’s insurance company. ?The ?Ontario insurance regime allows accident victims to ?file an accident benefits claim ?at the same time as a tort claim.

If you have been injured in a pedestrian accident it’s important you know your rights. ?We can help you by coming to you and explaining the best course of action to make sure that you receive the medical treatments you need as well as maximum financial compensation to make sure your needs are taken care of now and moving forward.

Have a great, safe long weekend ! Ottawa Police targeting speeding and pedestrian accidents.

Personal Injury Lawyers in Ottawa Ontario

We can all help in working towards reducing the number of accidents in Ottawa and Gatineau. In an effort to keep our streets safer, Ottawa Police and Gatineau Police are focussing on pedestrian safety and reducing speeding in the Ottawa/Gatineau area.

Did you know that…

Between 2008 and 2012, there were 1,814 Ottawa/Gatineau accidents involving pedestrians which resulted in 1,706 personal injuries and 38 deaths.

Did you also know that…

Between 2008 and 2012, there were 16,033 Ottawa/ Gatineau accidents as a result of ?speeding ? These accidents caused ?4,543 personal injuries and 69 deaths.

Yes, accidents happen; however these accidents can often times be prevented. ?The Ottawa community wants safer roads and if everyone does their part, we can have them. ?The Ottawa Police are on board, Ottawa schools are on board, the community is on board and now we need every individual on board. There are many Ottawa community initiatives already in place to promote a safer and healthier community. This means all drivers, cyclists, and pedestrians need to be a part of a safer Ottawa environment. An accident can change your life in an instant and your life may never be the same again. I meet daily with families whose lives have been completely altered by an accident. An accident affects the lives of not only the injured but usually everyone around them; especially family members.

Set an example for your children. Please, talk to your kids about driving responsibly. ?If you are the driver, remember these statistics the next time you are contemplating putting your foot on the pedal to get there sooner. Your health and the health of your family is incredibly important.

As we head into the long weekend, many people will be driving on highways to get to their destinations, I urge everyone to please drive safely and have a great, safe long weekend.

What to do if you have been injured in an Ottawa pedestrian accident and don’t have insurance.

Pedestrian Accident Lawyers

We recently helped a woman who was crossing the street and was hit by a car. She was badly ?injured and told that the accident was her fault because she was not crossing at a cross walk. ?Our client did not own a car and therefore had no insurance. ?She had no idea that there were accident benefits available to her and she didn’t know where to start.

What she needed was a free legal opinion.

What all pedestrians need to know is that if you are injured you may be entitled to compensation through Ontario accident benefits and/or through a tort claim. The compensation to which you are entitled will depend on if you have insurance, if the driver has insurance, the extent of your injuries and other determining factors. Each case is unique. An experienced personal injury lawyer can offer you advise and help you map out a course of action. You may decide not to file a lawsuit or may decide to file a tort claim. ?A tort claim is when a lawsuit is filed against the person responsible for the accident. ?What this means is that a claim is made against the driver’s insurance company and the driver themselves. ?My client was very reluctant to sue someone personally. This is a common feeling. ?Many people feel this way and don’t want to sue someone. ?We understand this concern but explain to our clients that when a tort claim is made , it is not the individual that would pay out the compensation but rather their insurance company.

If you are at fault and do not have insurance of your own, you may still be entitled to compensation. ?A ?claim can be filed at the Motor Vehicle Accident Claims (MVAC) Fund. This is a fund specifically designed for situations where someone is injured, requires compensation but there is no insurance company to sue.

All this to say, our client needed support and compensation. ?We were able to help get our client the medical, rehabilitative and financial support she needed to start rebuilding her life after her accident. ?Here is what she had to say…

“Thank you David. ?You guys have been amazing. ?I’m so thankful that you believed in my case and helped me; especially given the fact that I thought we had no options. We are going to start the summer with a new attitude on life and a lot of that has to do with what you guys have done for us. Thanks again.”

It is tough to know what rights you have as a pedestrian when it comes to insurance and insurance compensation. If you have been injured as a pedestrian, it’s always best to consult with an expereinced personal injury lawyer to know about your rights. Most Ottawa personal injury lawyers offer free consultations and can sit down with you, review the facts surrounding your accident and help you determine the best way to proceed to ensure you are well taken care of. It never hurts to hear your options.

To avoid a pedestrian accident, you?should…

  • always cross at crossways or traffic lights

  • only cross a road when traffic has stopped;
  • be cautious when crossing and do so promptly. Don’t waste time and make sure you get completely across before the light changes.
  • do not wear headphones to listen to music. You need to hear the sounds around you.
  • be aware of cars that may be turning and may not be able to see you;
  • as much as possible, wear bright clothing or reflective wear and make yourself as visible as possible. ?Most of all, use common sense.

In our personal injury practice we see the potentially life-long implications of a severe head injury.? A brain injury is an invisible injury and yet it is one of the most devastating and life-changing injuries we see in our personal injury clients.? A brain injury can completely alter someone’s personality and leave them in a state where they do not know how to control their anger and emotions. Many people don’t know how to manage themselves and often times their friends and family react the same way.? With a brain injury being an invisible injury, family and friends often think that the injuries are not that serious and that the injured is just “mad” or “unresponsive”; when in actual fact this behaviour is a direct result of a brain injury.

There are many different degrees and levels of a brain injury from mild to traumatic. What’s important to know is that if you or a loved one is suffering from a brain injury there is help and support for you and your family.? Ottawa has tremendous organisations that focus on brain injury awareness and support people with brain injuries.? Ontario Accident Benefits also provide significant benefits to people who have been in an accident in Ontario and have suffered a brain injury. No one needs to suffer with a brain injury.
